Operation of this website

1.0 Operational ownership

1.1 This website is operated and owned by Goju Ryu Academy Ltd (henceforth referred to as the 'Academy' in the remainder of this document).

1.4 By accessing and continuing to use any part of this website, visitors shall be deemed to have accepted and be bound by these terms and conditions.

1.5 This agreement represents the complete agreement and understanding between the Academy and any visitor to this site.

1.6 Any new features added to the site in the future, shall be subject to the same terms and conditions, unless otherwise stated.

2.0 Operational continuity

2.1 We will take reasonable steps to ensure the library content is available during the period of your subscription, but we do not provide any minimum guaranteed up-times for service availability.

3.0 Operational efficiency

3.1 The speed at which you will be able to download our videos will be subject to a range of factors beyond our control. We will continue to monitor technological advances in video compression techniques and availability of new hosting services to maximise efficiency and minimise download times.

3.2 As the user of our services you have to accept sole responsibility for choosing a suitable broadband connection that allows you to download our video content over the Internet. You will need a reliable and reasonably fast broadband connection to make best use of the high quality video service we provide.

3.3 To evaluate whether your local broadband service is up to the task, we recommend you attempt to watch the sample video we have provided. If you find the video plays smoothly and without interruption then you should enjoy a similar experience accessing the other library videos that will made available to you once you subscribe.

3.4 If the sample video stops and stutters during viewing, we are afraid this is an indication that your broadband connection is too slow for the type of video streaming we currently use.

3.5 Although the video will eventually load and you will be able to watch the video, you should carefully consider whether the slowness of your available broadband connection will spoil your enjoyment of our service. You should consider delaying subscribing to our service until you have made arrangements to obtain a faster broadband connection.

4.0 Refund policy

4.1 Once you have subscribed and accessed the online service you will be able to view all the material within the library available to your level. We therefore consider that the Academy´s contractual obligation to provide the designated service has been met and fully discharged on the first occasion you access the system. The fact that you can continue to return to the website and enjoy the convenience of accessing the same, or perhaps new material, for a period of one year is incidental to the contract for services between us.

4.2 For this reason, the Academy will not make refunds to subscribers who no longer wish to use the service once they have accessed the service for the first time.

5.0 Intellectual Property Rights and Copyright

5.1 All intellectual property rights and copyright to the design, methodologies, technologies, imagery and text content are reserved by the Academy (and its licensors). They are non-transferable.

5.2 Visitors are NOT permitted to download and print extracts from this site, under any circumstances.

5.3 No part of this website can be reproduced or stored in any public or private retrieval system or service without the express written permission of the Academy.

6.0 Privacy and retention of personal details

6.1 This notice applies to all information collected directly from this website.

6.2 When visiting this website and signing up for, or using our facilities through any of our service or subscription pages, you may choose to supply us with information that identifies you and/or your organisation. This information may include individual or business names, various contact information, billing details and more general information about the nature of your business and services you may already use, or intend to subscribe to.

6.3 We use PayPal to collect online subscription payments. The Academy never collects or stores, in either physical or electronic form, the details of any credit or debit cards used to settle on-line purchase transactions.

6.4 We use the information you provide about yourself and others to complete the transaction for which the information is intended. Such transactions may include administering a service such as search management of online databases; supply of syndicated news, infosheets or downloads; and replying to support requests; or contacting you directly in connection with the running of the services you already have, or you may subscribe to.

6.5 We also collect non-identifying and aggregate information to better design our website and services in the future.

6.6 From time to time, we will use the information you provide about yourself or your organisation to keep you informed of additions or improvements to our services and products. When supplying name and contact information to us, you indicate your willingness to receive such information and updates about our services and products.

6.7 If you do not wish to receive future emails containing information about the additions or improvements to our services and products, we shall include a means of unsubscribing so you can remove your details from our records.

6.8 We do not knowingly share the information we collect from you with any third party.

7.1 Nothing in these terms limits or excludes the Academy´s liability for death or personal injury caused by its proven negligence. Subject to the previous sentence, the Academy shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise): (a) injury or death to self; (b) injury or death to third party whether they be a training partner, assailant or bystander; (c) loss of data; (d) loss of revenue or anticipated profits; (e) loss of business; (f) loss of opportunity; (g) loss of goodwill or injury to reputation; (h) losses suffered by third parties; or (i) any indirect, consequential, special or exemplary damages arising from the use of this website or its contents regardless of the form of action.
